Consultation on the draft guidance for education providers

We have drafted guidance about the implications of the new Equality Act for education. We have produced two versions of most of this guidance, one aimed at education providers (this one) and a similar set aimed at students, pupils and parents. Unless you want to respond to both versions of the guidance, please comment on the version that most closely matches your role. Swap now to the guidance for students, pupils and parents if you feel that is more appropriate.

How to give feedback about the guidance

Once you have clicked below to ‘read and comment on the document’ you will see it has been organised into chapters for each topic. In the left hand pane you can expand the chapters and sections, and navigate around the guidance.  You can comment on as many or as few chapters as you wish.  We are inviting comments by chapter, so when you want to comment on a chapter, please go to the beginning of that chapter where you will find an ‘add comments’ tab in the right hand corner. Select this and a series of questions will appear. Please use the space to give us your feedback about that chapter of the guidance.  You can save your response as a draft and return to it as often as you need. You can also ‘copy and paste’ text from other documents if that makes it easier to respond.  There are options to download or print the document or sections of it. Please use the Site Tour to explain how to use this site if you are not sure.

Scope of consultation:  Once the guidance has been finalised it will be produced in a range of user-friendly ways rather than just as a long document with many chapters.  At this point we are not consulting on the presentation of the materials, just the content. We want to make sure that we explain the new law in ways that make sense to those who will have to use it. Likewise, we are not consulting on what should or should not be included in the Equality Act – consultation on that has been undertaken by the Government over the last few years.  For this consultation we would like you to focus on how well this guidance helps you understand your rights and/or responsibilities and how to comply with the law.

The draft guidance applies across Great Britain, covering England, Scotland and Wales. Where there are national differences in terminology, practice, procedure or policy these are reflected in the main body of the text. If you identify issues or sections where this is not clear enough for any of those nations, or you think we have not given enough attention to national differences please let us know or suggest improvements for when we prepare the final drafts.
